Japan Makes an Important IP Comeback

Separator

As technology becomes more intertwined with daily life, intellectual property (IP) conflicts have surged globally. Japan filed 300K patent applications in 2023—an increase of 10k applications from 2022 level. In fact, the Asian continent has maintained its momentum in the global arena, continuing to lead in international patent filings through the World Intellectual Property Organization (WIPO). In 2024, Asia accounted for 55.7% of total filings, a notable increase from 40.3% in 2012. Recently, a Japanese supplier of semiconductor test equipment secured a $20 million settlement in a JAMS dispute with a Singaporean competitor. This resolution came months after a California court ruled that the arbitrator had exceeded his authority by issuing discovery subpoenas to non-parties. Protecting intellectual property remains a critical component of a product company's growth strategy.

Given the prevailing cut-throat competition across markets, scandals, financial crises, and the globalization of anything & everything, it could create stumbling blocks in your organization’s journey, not to mention the dynamic and swiftly evolving compliance landscape. Compliance is increasingly becoming a facet of continuing success stories. Ethical guidance and long-term risk management are paramount, whether a startup or an established organization.

Given the circumstances, the role of the Chief Legal Officer (CLO) has become increasingly vital and complex, undergoing significant transformation in recent years, particularly in Asia. Organizations worldwide now require CLOs to manage the intellectual property and compliance departments with the same rigor as operational units, thereby directly contributing to organizational growth. In this issue, we highlight exemplary CLOs who lead by example. We dedicate this special edition to the CLOs in Asia. We heartily welcome your feedback and thoughts.
